i believe his answer was that he wanted to make more money.
personally, i dont think people would have built their own debs from source instead of buying it for a dollar.
also, i would have donated quite a lot of money for it if it was open, as im sure would many people.

personally, i think everyone should flash an open kernel anyway. if you are the sort who messes with stuff and tries out new experimental things, you are probably less likely to brick your phone if you do.
the actual bug is trivial to fix, but no one has had the time or the phone {im still missing my n9} to fix it.
