I had a text from nokia saying the update was available but when i went to get it, it weren't there!

If you are talking about the couple of days old mail, that was for the new S60 OVI store.
Probably you're right that this mail wasn't for the N900, but it wasn't very clear on that in any way.

... here in germany still no ovi upgrade and besides, i got that stpid sms too cause i owned a n97 before, where i registered myself at nokia with it.
