Just got my "New" 810 from ebay today...Really bummed.
 
"Item Is New Never Used In Open Box" Is how it was listed. Bought it from a power seller who claims he has 50 of them for sale.

See attached images of what I got. Light scratches on keyboard and face. Chipped paint and heavier scratches on the bottom.

When I emailed him he basically implied that I was trying to get one over on him. That all his other ones were brand new in open boxes. So how did I get a used one? No applology, just a threat that is I didn't return everything back to him immediately with all accessories and screen protector he would report me to ebay. Bizarre! This is a power seller!!! Of course I have to pay return shipping. He better refund all of the transaction otherwise I'll be pissed. I should forfeit the shipping i paid him right?

I won't post the info (seller name) on this guy until I see how he handles the rest of the transaction. But if you are going to purchase one on ebay, PM me and I'll give you his name so you can avoid him.

Yeah thanks. I used paypal. Incidentally, I paid $353 after shipping.
Definitely worth the extra money to go direct to nokia or another retailer. Is it just me, or has ebay become more of a sordid affair than it used to be? I seem to be having some bad experiences time and time again.

Dude,

I did not have any problems with the front but I did have some scratches on the back. I bought mine right when they were released but got it from buy.com.

Sorry to hear your experience. Seems like demo units, that would explain the damage. I don't use eBay to buy anything beyond $100, even if it seems to be cheaper than a retail store.

Sounds like the MO of an unethical scammer. The best defense is a good offense.

Like any scammer, he likely knows the ins and outs of what he can *legally* get away with ... most likely because they have sepnt some time in a courtroom listening to lawyers tell them. You doing anything illegal to get back at him will just make you a criminal and lend them fodder for winning a battle of your word against theirs in a potential future court battle. The shipping to you happened ... they provided it so you have to pay for it becasue taht service was delivered. The cost of shipping it back falling on you is just the sort of thing the scammer is counting on providing enough inertia for you to just accept the shoddy merchindise.

Ship it back, pay for the shipping, expect a refund of the cost of the unit. If you don't, take them to smal claims court. Unfortunately, you will have to eat the two shipping costs ... take your pound of flesh by writing an honest review of their selling tactics to warn off potential future victims.

Another thing you can do is take down the serial number and MAC address just in case someone reports it as stolen on these forums as has happened in the past.

man, sorry about that. of the last few purchased on ebay, only one was somewhat honest, and even that item came with a broken piece. too many swindlers out there now. i've had better luck with craig's list and used amazon sales.

Another place to look (specifically for a tablet) are on these forums in the Buy Sell section. There seems to be a lot of people selling their old models after upgrading (tablet-lovers who took care of their old one) or selling new models after realizing that the tablet wasn't want they were looking for (people who didn't have enough time to wear out their old tablet). They go fast though.

The seller said that he received a large shipment direct from the manufacturer. Now that I think about it, if it came direct from Nokia, wouldn't it come refurbed/sealed?

At any rate, mwiktowy's comment "The best defense is a good offense." Really is true. I have seen that tactic countless times especially with shoddy car salesmen.
They try and make you feel like its your problem or that you have done something wrong.

Sorry to hear of your problem. I just bought a N810 for my husband off eBay on Saturday and he got it yesterday in great shape. The back had a few minor scratches but I know from my own N810 that the back scratches very easily - so no big deal in my mind. The rest of the body & screen is pristine. We paid $363 including shipping. So I guess you never know...

As for your refund $$ issue - if you paid with PayPal and the guy has > 50 feedback (if he's a powerseller he will) and if the majority of that feedback is positive then PayPal says they will cover your purchase up to $2000 when the item you receive is significantly different from the ad. I would start there if it were me. PayPal can put a hold on the seller's fund in the case of a dispute, if the seller has any funds in their PayPal account.

I really hope this all works out for you. :) eBay can be an excellent place to buy items.

PinCushionQueen I agree with you, I had a similar experience on Ebay and I got my money back, but only after a long time period and a nasty dispute.

I had a bad experience on ebay buying a used computer. From your ebay account page look for the link to the dispute console. Open a dispute. You will then correspond with the seller through ebay to try and resolve. If you can't work it out you can escallate it to a claim. This will be handled by PayPal.

I went through all of this and was refunded my money eventually by PayPal. PayPal either froze the sellers account or took the money out of his account, because the same day I finally got my refund I got an email from the seller begging me to work out a deal.

Maybe, I have seen incidents in the past here on this forum where people got units from Nokia that were highly questionable as to how Nokia was claiming to sell them as new since it was clearly apparent that they were used units.

As a rule I never buy from ebay shops if their rating is below 99.5%

It may be only a small difference, but in my experience sellers with a 98% or, eek, 97% rating are those to be avoided.

I bought my n810 new about 6 weeks ago now, from Let's Talk, the Nokia USA distributor, just at the time there was that killer discount on them that Nokia rescinded 24 hours later.
Anyway, when I got it it came in a sealed Nokia box, and looked brand new. However, when I started it up for the first time it didn't ask for any of the usual bluetooth phone pairing, nor did it require the home nor Visiting cities setting (as they were already set to London and Paris IIRC).

When I took a look in the on-board memory there were a bunch of files that were not Nokia created, and there was also an entry in File Manager for "Yoshi's Laptop". The machine also didn't seem to be working 100% browser-wise.

I complained, and returned it, got a new, new machine. Even more interesting this new, new machine came with a Nokia seal holding the box-flap closed, whereas the old-new machine had a plain seal in the same position.

eBay is substantially raising prices for sellers and driving out sincere low-volume sellers. So it's not the good deal or friendly place it used to be. I used to be an eBay fan; now I'm permanently boycotting eBay.

The best way to hurt ebay if you're unhappy with their procedures is to use one of their rivals. Rival auction sites aren't as good in terms of selection, but they would get better if more of us used them.

I'm sick of Ebay's virtual monopoly.

It's certainly disconcerting to hear that even Nokia is guilty of sending out used items as new. For crying out loud, why don't they just open up an outlet online that offers discounts for open box items. That way there's no surprises and everyone is happy.

This seller sent me the tablet in a beaten up retail box that had open box written all over it.

I think sellers like this count on bring up their rating by the shear volume of product they sell. 148 Negatives out of 8000+ is still 148 people that were really unhappy.
There are other power sellers out there that still have a 100% rating

This is a solid lessen learned by me, and I hope others reading this don't make the same mistake. The gamble to save $30-$50 sometimes just isn't worth it.

To make myself feel better about the whole situation, I whipped out the credit card last night and ordered a "new" 810 on Lets talk last night. I hope it goes well.

eBay has a historical problem with "tit-for-tat" blackmail, where sellers keep up their positive percentages by threatening buyers with a negative review if they give the seller a negative review. That's why a few consistent negative comments outweigh a "98% positive" review. eBay recently made some changes to try to prevent this practice, but I don't know how it's working out.

my brother went through a dispute and got a refund for very faulty goods, he posted neg feedback and the seller did likewise. he got a cheap lawyer's letter off to ebay stating that they were publishing an incorrect fact which was slanderous and ebay removed it very quickly.

Nokia will not send used items as new. Resellers, however, just might.

Resellers can be bad. My company knew of well-known resellers who re-shrinkwrapped software that was returned, thus causing customers to claim that our software had viruses in it. We of course would have known instantly if we sent out software with viruses, since our phones would have been ringing off the hook, and not from software from only certain resellers.

On a different subject -- the new management of eBay is just plain evil and should be avoided. I'm looking forward to the rise of a really viable alternative auction-related site.

dude, you have some misinformation there.

sellers will still be able to leave FB, just no negs or neutrals. but, in effort to reduce buyer scams, ebay will also increase bidder requirements sellers can set. also, a mechanism will be in place so sellers CAN dispute unfounded negs.

a perfect system? far from it. doom & gloom? not even close. an excellent resource for ebays news is over on AuctionBytes (http://www.auctionbytes.com)

the reason for the majority of changes are to repair the damage to the ebay brand done by Megholio & her minions.

weeding out problematic sellers is the goal. you know like the op's seller. the best advice given to the op is to file a SNAD (significantly not as described) complaint. if that fails then if you always fund payments via credit cards buyer's have that added protection. it stinks when probs come around and they can be frustrating, but things usually work out.

i never advise folks buy compters or electronics on ebay unless they REALLY know what they are bidding on AND research the seller, fully reading the auction term. i have bought two of my last three laptops on ebay (one even from a seller in Canookia). excellent deals both times. bought the one iin the middle direct from dell and got completely hosed. so, it does happen elsewhere too. but, it does happen waaaaay to frequently on ebay because of slimeball sellers.

mail order has always been spooky, ebay can be also, but if you use good judgement it's pretty safe.

btw, buyers who worry about getting retailiatoy negs don't 'get it'. feedback is meanless to buyers. well, unless you total fb is under zero. and never buy with your selling id. use a buying id so being honeest with fb for a seller won't affect you seller rep.

Breck, I don't accept ebay's rationale for removing seller feedback features. It was a useful tool for me as a seller and its removal is one reason I quit selling on ebay. Delayed payments was the other. Like many, I will be using ebay alternatives going forward.

Just a point of distinction: that's not Nokia, that's LetsTalk, a reseller. Unlike LetsTalk, Nokia has no particular desire to confirm upon which cheek your third grade teacher had a mole that looked a bit like Kermit the Frog. Also, and not to alarm you, but there's been some, well, talk of LetsTalk resealing "lightly used" units and passing them off as new. I do see that the order was placed through a company called lets talk. However, I purchased through the Nokia site so I would hope that it is still considered a purchase direct from Nokia. The whole transaction seemed to be within Nokia's site, but the email confirmation clearly came from letstalk.

asqwasqw-thanks for the correction, I have always thought it was "sorted" (which I suppose made sense in my head).

But you know, Sordid really does describe the state of ebay of late.

Letstalk is used as a fulfillment center. This is a common practice when companies sell "direct." Letstalk actually has the stock on hand and handles everything related to delivery after the order is entered.

Ok, jusy thought I would post a follow up to this thread...
After 2 emails, no responses and after 3 days of the seller receiving his scratched n810 back, he REFUNDED MY MONEY. Iam thankful that it didn't drag on any longer than that. I got the feeling this guy will screw with people just because he can (after reading some of his feedback).

So, the lessen learned, don't buy anything from a powerseller that has more than a couple negatives, don't buy anything from a seller that has the words: Dirt, Cheap and Liquidations in his seller ID
