the supplier of your retailer probably decided not to carry the n900 after all. it has nothing to do with the manufacturer, that's just a standard message.

Ive set my mind on week 43-44, like official sources have told, if it comes earlier Im happy, but only time will tell...

And my guess is the phones will be out within 2 weeks, because they are trying to get more and better software on the phone before they release it to the world. They are probably reading reviews of the phones they gave away in Amsterdam and fixing software right now.

Funny, all the press release rehashes from Aug 27 say "October in select markets". Anything else hasn't gone out officially at least, although there was the rumour US distributors would have it in late September.

I'm sure you're just kidding but they might have a good reason not to ship to or release* from distributors yet. A minor bug in a new device can put a serious damper on its future prospects. While we're understanding of such things, major reviewers generally are not.

No matter how badly everyone here wants to see the N900 ship there are a bunch of folks at Nokia that want it even more. They'll ship it as soon as they can and not a day more so they can get paid ASAP. Every day is a lot of lost money to them. There is nothing we can do about it except be patient and understanding.

I think the earliest legitimate and verifiable sign that a real shipping date is soon is when people start reporting their CCs getting charged. Everything else should be taken with a grain of salt.

With all that said IMO Nokia might have been able to handle this matter a little better. Apple generally refuses to comment on ship dates until they are ready to ship within a few days.

As for a lawsuit IMO there's really not too much there. The release date was tempered with the usual disclaimers [on their website et al] so no real promise was made and AFAIK no direct preorder charges have been placed. Again, I'm sure you were kidding and its to the benefit of others. Suspect there are a few JDs here that would have a more enlighten thought on this.

* I'm surprised that no one out there has posted any pictures of N900s sitting in a distributor's warehouse which makes me question the veracity of such eyewitness claims.
