Hi,
I thought I'd throw in my two pence worth here. I've been following this for a while as well as the MSE and Voda forums and all have been a massive help in attempting to cancel, so thanks everyone and thanks to the OP for the original info! I finally got my text message and sent off my cancellation letter last week, I emailed a copy to the directors office, Guy Laurence and someone else (can't remember the name now?) and as suspected it found its way to Karen Johnson. She sent me the generic reply that I believe most people are now getting which states; "Thanks for your email regarding out of bundle charges. I can confirm that we are currently reviewing this matter, we apologise for any delay and we will be back in contact with you shortly via letter. We appreciate your patience regarding this matter." I have to admit, I don't know what to expect? I assume that their legal team is looking for a way out, however there are two very good reasons I don't think that they can get out of it! First Vodafone did not give me any notice whatsoever when they increased their roaming charges, something that they state in their contract they will do. Also anyone who thinks that these charges do not form a part of their contract is seriously mis-informed as these charges are referenced within the contract (although they point you to the website for up to date costs) and therefore form part of the contract and are subject to the terms within the contract, including giving reasonable notice of an increase in these charges! The same point applies for internet charging, although obviously Voda have realised this, hence the text message saga! However regardless of them now complying with their own contract and giving us the required notice for the increase in charges, it doesn't change the fact that a number of people will be at a "Significant disadvantage" in most cases financially. This again is stated in their contract, and Voda themselves have set the bar at a 10% increase on your bill being considered a significant disadvantage giving you the right to cancel. If you fall in to this category then you have the right to cancel by VODAFONE'S OWN ADMISSION!!! The fact that they have now let several people cancel based upon their own rules, should mean that this is set in stone, otherwise I would personally consider it to be discrimination. If I meet the criteria I have just as much right to cancel as the next guy! I fail to see what they can put in a letter that will change any of these facts, therefore I can only assume that anyone that will be receiving these letters will be getting their cancellation request fulfilled as they rightly should. I suspect that instead of dealing with so many individual requests it is easier for them to wait for the cancellation letters to flood in and then deal with them all at once via a standard template, at least I hope this is the case. If not there is still no way I'll be giving up! Ok rant over... thanks for listening! :) Lee |

Well 22 days after the first cancellation letter was RECEIVED by Vodafone, they finally sent a reply
to the WRONG address, they sent it to my old address I lived in last year, even though I've changed it many months ago on their systems, and all the letters I sent to them had the new address The letter (which I havent seen yet) aparently says they are looking into seeing if I can cancel or not If I said what I thought of the people working there or the company I'd be banned from here for swearing so much. HOW can someone work out how much their next bill is going to be, assemble proof of how much that bill will be more than 10% of last months, send a cancellation letter BEFORE the bill is produced (which I have) yet they dont bother responding with a decision until after they produce the bill? ARGHHH I really wanna swear |

I got a letter yesterday, basically acknowledging the letter I sent and saying that IF I am eligible to cancel then it will take place on October 1st.
I am confused to see how some people they have let out and others they are trying to keep tied in well we are all in the same position. My bill will go up by about 40% which is way over the 10% they set in the contract. Snaps did you constantly ring them or did you just leave it and see what happens. I am not really happy waiting until October, I want to know now so I can sort out a sim free package and port my phone number over. |

I wonder if the reason some people have been allowed to cancel sooner is because they have already exceeded their allowance by a reasonable amount for their next bill i.e. used more than 500Mb in the first several days of their billing cycle for the bill due end Sept/ through October.
I can't see any other reason for this, we are all subject to the contract and cancellation conditions! |

I realy do HATE Vodafone
I used between 3-5gb the past 3 months last month once they sent the text saying I was approaching the 500mb limit and if I went over I'd be charged, I went over by about 250mb just to make sure I was over, then all the cancellation letters I even supplied the proof they wanted to show that I believed my bill would rise by more than 10% now today I get the bill and the b@stards didnt charge me what more can I do? start going over again and again until they do charge me? |

Just because Vodafone choose not to publish their charges in their contract doesn't mean they have free reign to charge people what they want for whatever service they want. My specific monthly cost for my tariff isn't shown on the contract, but I'm pretty certain that they couldn't suddenly decide to charge me double for the same service! I know this isn't the same as the enforcement of the FUP charges, but the principal is exactly the same in that the specific costs are not stated in the contract, they are only referred to in a general manner, but they still form part of the contract. I hope this makes sense... I know what I mean! :D |

already done once I got the text, the letter is the first contact from them after sending in the cancellation letter along with proof of why I think my bill will rise by at least 10%
Also many emails to the directors office, I'm just totally dissapointed by Vodafone and have lost all respect for the company, I'd never use or recommend them to anyone after this fiasco |

XXXXXXXX I hereby request the termination of my pay monthly mobile telephone contract with Vodafone in accordance with §11 of your Pay Monthly airtime agreement terms and conditions, and request you to send me my PAC number, via SMS / Email. These are the reasons I am requesting termination of this contract: I bought this contract in December 2009, and was clearly billed as “unlimited” data, and I now have received notification that you will start charging me £5 for every extra 500mb I use over a “supposed“ fair usage limit of 500mb. This isn’t fair usage any longer, it’s now a limit that disadvantages me, the consumer. According to §11b (enclosed) of the Pay Monthly airtime agreement, I quote “we increase your charges in the UK which have the effect of increasing your total call and usage charges (based on your usage in the previous month) by more than 10% and you write to us before the increase applies”. If you increase my charges, as intended on the 1st October 2010, and this has the effect of increasing my bill by more than 10% based upon my previous months usage I am entitled to cancel. This will be true as you can see from the summaries of my most recent 3 bills (enclosed) As of the 1st October 2010, the new charging structure would increase my monthly bill by £10 per month based on the fact I have gone over 1gb (I will incur two extra £5 charges). This is an increase of 33%. And based on my last months (august) bill of £XXXX, is still an increase of 20%. Every month for the last 6 at least, it appears I have exceeded 500mb. So would at least incur one £5 charge per bill. As none of my bills have ever exceeded £50, this clearly shows that my bills would have been increased by over 10% on every occasion. I’m certain this is proof enough. The changes to my agreement as outlined above will mean my mobile data usage will be subject to automatic out-of-bundle charges and no Fair Use Policy, a change which is to my “significant disadvantage” financially, as it restricts use of data services, specifically mobile applications, for the remainder of my contract. Any attempt to impose them on me without allowing a penalty–free right to cancel, is unfair and unenforceable as a matter of law. I just found a good plan I'm thinking about on the three network £15 per month for @one month at a time contract. cancel any time you like. 1gb of data (enough for me) plus more mins and texts than I get now. It means I can just get a new contract whenever i like a new phone, OR I might go for a new xbox connect thing when it comes out as a 'free' gift.
BUT it says offer closes on 30th september. I have also had the letter that says vodafone will decide on 1st october. It's truly a crap position to be in. Might ring 3 and see if they will start it in a couple of weeks or something but give me the same deal. |

£15 Tariff 1 Month Contract (500 minutes plus unlimited texts and data) Sounds a better deal than giffgaff who do the same but with only 300 minutes. |

Just checked and my contract is due to expire in a couple of months anyway so frankly can't be arse to jump through hoops. I'll just tell Voda to stick it when they contact me about upgrades etc.

I am waiting for mine to be cancelled, I keep hassling every email address I can possibly think of in order to get further.
The phone is yours, they do not own it, it comes as part of the contract. If you break the contract then yes you return it, however if they break the contract then it is yours to keep. In this case, it is them that are breaking the contract hence, phone=yours. |

from what I understand, the majority of people will be allowed to cancel on 1st Oct on the date the charges are introduced. I spoke with Customer Relations yesterday and this was the vibe, in a sense that 1st Oct will be a day dedicated for cancellations (with a few people lucky enough to slip through and cancel every now and then beforehand).
Im happy enough to wait til this date because that will be that 30th day of my Notice Period. After that, they will once again be in breach of the T&C's i signed, clause 11a and 11b.1 which summarises, either party must give 30 days notice to end agreement, and then; you can end the agreement if vodafone fail to do something essential that they should have done under this agreement. |

Anyone knows if the iphone only simcard (30 days contract) advertised by Vodafone UK will work on N900? It comes with 1GB data.

I believe the iphone4 takes what they call a 'microsim' which is smaller than a normal one. Not sure if it can take a normal one too or not. The iphone3gs takes a normal one, so if it says the sim is compatible with that one, then it'll fit in a n900. I was going to go for the three network iphone sim only deal and came across that. Think I will go for giffgaff now, 30 day rolling contract, as has been posted already on the last page by a very kind person.

I contacted them about the text I recived, and said I want to cancel, and the email they replied was
"Hi Jonathan, We are launching a free service on June 1 by alerting those customers who consistently use more than their data allowance. This alert will say we will review your spend and if you continue to use more data than your allowance consistently over the coming months, we'll contact you to have a chat about your usage and offer an alternative data plan to avoid incurring out of bundle charges. That means you will be able to manage your usage more effectively, we’re also giving clarity to what these data rates are for out of bundle charges. Given you are already reaching your allowance and in some cases are over, from June 1, you will start to receive an alert to say you've gone over your allowance. We will be tracking your usage, and in the following months if your usage continues to be over your data allowance, we will contact you to discuss alternatives (including for example, upgrading to one of our mobile broadband plans) and that you could incur charges. I appreciate you were told that you had a price plan with unlimited data allowance, what we're doing is clarifying exactly what we mean by unlimited data allowance (500 Mb). As you know we have a Fair Usage Policy and for the vast majority of customers, they do not use more than their data allowance. Trust the above information helps." Does this mean I cant cancel? or are they just trying to put me off trying |

southwalesboy - That is the standard vodafone line from a few months back when they were still trying to deny they were changing anything much on the contract. Just use the template cancellation letter &email and put your details n and see what happens. In about a week we should all find out if we get to cancel, or if there is another twist in this saga.

I have had 2 emails now, the second one stating... Hi Jonathan, I can see that you are on 18 month price plan with 600 minutes, unlimited text, Vodafone passport and VMI (Vodafone mobile Internet pack). I assure you that VMI always has a limit of 500 MB usage, If you exceed this limit you will be charged extra £5 for an extra usage of 500 MB. There is a fair usage policy on all services provided by Vodafone. I trust this helps. I am pretty certain that the old fair use policy had no mention of a £5 charge per 500mb! Does anyone have a copy ? |
