Re: Attention all N900 Vodafone users in the UK!
Meh, I'd love to get out of my vodafone contract.. hoping that this means I can!
No text over here either! |
Re: Attention all N900 Vodafone users in the UK!
You see even if they dont send you a text, you can get out of the contract, only if you can show that your bills will rise by 10%.
Quite frankly, I think this is UNFAIR, as what if I go over in the future? I will be charged. NO THANKS. I will dispute this! |

VF eforum states there may not be a change to T&C's, and instead re-inforcement of excessive usage charges. |
Re: Attention all N900 Vodafone users in the UK!
Meh, this is just stupid!
I don't get why they just disallow any modifications to current in-contract clients - and then just have future revisions for future clients if they decide to change anything. I shouldn't have to prove anything, the fact they've changed my terms should be enough ground to cancel! |

same here..

Re: Attention all N900 Vodafone users in the UK!
no text here either...
@dbs11 this is a change in t&c however they try to word it. No where in my contract does it tell me what the standard rate for going over 500MB is, this means they can't introduce one and think they can get away with 'this isn't a change' If they charge me for going over 500mb, then its a hard limit and not a FUP and therefore a change in T&C. I have sent my cancellation letter in today just so I know they have got it before the start of the change (1st June)... see what happens then. |
Re: Attention all N900 Vodafone users in the UK!
Yep...nothing here. Up to 1.9GB on unbilled usage so far this month...

- first get in contact if you go over - then talk to you about limiting you data - then throttle you connection - then charge you (this is the important one) Now in order for them to charge you they need a plan in place to charge. As you have all read they are charging £5 for every 500meg. However i cannot find anywhere any plan in place for charging on my current terms and condiditions. it simply states they reserve the right to charge So they are going to have to amend the T&C to reflect the new charges. They may deem this as a small change and therefore only need to give you 14 days. which they haven't A change is a change, if this effects you using the 10% bye bye vodafone This is how i see it anyway and this is what i believe Sjaman was talking about below Quote:

Re: Attention all N900 Vodafone users in the UK!
I wish i could remember the post which talked about the handset on the eForum. Hundreds of posts now will make it difficult to find.
Im waiting a few days before calling them myself. Getting enough ammo ready for a fight. |
Re: Attention all N900 Vodafone users in the UK!
This is bizzarre, i've not had any text, letter or notification about this from VF and I use around 750mb a month on average so far!
I need to call them to ask about a much higher usage over the next billing period as I am away on tour for a few weeks with a band and will need access 24/7 to the net and very much doubt every venue will let us use the WiFi! Dare I even ask about this charge? Or...Do I just claim ignorance as I've not had my 14 days notice?! :D |
Re: Attention all N900 Vodafone users in the UK!
You are about to be connected to a online customer service adviser for Vodafone UK.
You are now connected with Shailesh. Shailesh: Hello, you're chatting with Shailesh, one of Vodafone's online customer service specialists. May I take your name please? You: Hi, My name is xxxxxxx Shailesh: Thank you Shailesh: How may I help you today? You: I would like to enquire about the change in my terms and conditions regarding the mobile internet charges You: I have read on the vodafone forums that I will be charged £5 extra if I go over my 500Mb allowance Shailesh: I'll help you with this You: however, I have signed a contract woth vodafone which does not state any charges Shailesh: Yes, that's correct Shailesh: This will be effective from 1st of June 2010 You: additionally, vodafone have also failed to notify me regarding any changes to my terms and conditions You: therefore I should be fully and legally entitled to cancel my contract with vodafone without incurring any additional early cancellation charges Shailesh: Give me a minute You: the Vodafone Terms and Conditions state: “7 Changing charges and terms a We may change our charges or introduce new charges. If we increase our charges, we will give you at least 14 days’ notice and you may have a right to end this agreement under clause 11. If we believe any change in our charges will not disadvantage you, we may include it without telling you. b We can make changes to or withdraw services at any time and we can make changes to or introduce new terms to this agreement at any time. We will give you at least 30 days’ notice of these changes if we do and you may have a right to end this agreement under clause 11.” You: I have not received any notification whatsoever about the changes to my terms and conditions and my contract, as required by the Ofcom General Conditions (that Vodafone must observe at all times while operating as a service provider) state: “9.3 Where the Communications Provider intends to modify a condition in a contract with a Consumer which is likely to be of material detriment to the Consumer, the Communications Provider shall: (a) provide the Consumer with at least one month’s notice of its intention detailing the proposed modification; and (b) inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer.” You: Therefore I have the legal right to reject the changes to my terms and conditions and cancel the contract without incurring any additional charges. You: Is this correct You: Hello? Shailesh: The fair usage policy for the Vodafone Mobile Internet (VMI) bundle is not in the terms and conditions of your agreement and we have given the required amount of notice for the change to take effect (14 days), this does not come into effect until the 1st June 2010. You: You have not given me any required notice You: i have not receive an email, text or a letter... You: Therefore, you in my case you have not given me sufficient notice of these impending changes... Shailesh: We are only monitoring from the 1st June, not charging you You: This is not what I have been reading from the Vodafone forums, where administrators have been saying that it will kick in 1st June You: I have also spoken to customer support, and they have also advised me the same Shailesh: xxxxxxxx, this is wrong. Tthe forum advises that we will monitor the usage, will not charge you. The forum does not say we will charge. You: I have avidly been reading the 80 page thread on the forums. You: There are many misunderstandings. Shailesh: Let me check your usage You: Either way. I want to enquire about cancelling my contract because vodafone have violated their own terms and conditions You: My usage is not above 500Mb You: however I signed up to a Fair Usage Policy, which will not exist anymore, as you will be charging customers if they go over 500Mb. So this is a hard cap, which I have not agreed too Shailesh: Ok Shailesh: If you are not exceeding 500 MB then this will not affect you You: So just because I have not gone over 500Mb yet, doesnt mean I wont in the future, and I should not be expected to pay penalty charges You: As you understand. I do not agree with these terms and conditions You: and I should be fully entitled to cancel my contract without incurring any additional charges... Shailesh: Please go through this link You: I have not received any 14 day notification Shailesh: Click here You: Yes I have read that. You: the point is, I have not received ANY notification of these changes, as i SHOULD have, and therefore I should be entitled to cancel my contract without any additional fees involved... You: This is stated in your terms and conditions... Shailesh: We have not started charging and you will not be allowed to cancel your account without penalty Shailesh: You can read this by clicking on the above link You: But, you have FAILED to notify me of these changes... You: And legally, you SHOULD have notified me! You: as stated by your own terms and conditions and OFCOM! You: Is this not the case? Shailesh: We're not charging you, we're monitoring it! You: I understand this You: ok... You: Should you or should you not notify me of these changes 14 days in advance? Shailesh: I"ll transfer this chat to one of our specialised customer relations team You: no thank you. Shailesh: They will assist you further You: I would like to end this conversation ****ing idiots really. |

Re: Attention all N900 Vodafone users in the UK!
Signed and reposted to facebook - I would recommend people doing the same.
I do not go over the usage as I mainly use wifi, however the way they are going about it is wrong. |
Re: Attention all N900 Vodafone users in the UK!
no text... is it stated anywhere what the exact charges are??
also, can we check how much we used in unbilled usage so far?? I reset my data counter by mistake yesterday...... |
Re: Attention all N900 Vodafone users in the UK!
I've just been contacted by Vodafone via the phone.
They say that they cannot cancel my contract yet, until I can prove that the new charges directly affect me, even though all they have to do is look at my previous usage. Every month since I started my contract, i've been way over the 500mb limit. Apparently all I have to do is wait for my next bill to come through, with the extra charges, then call them, and they will "review my contract". Success! |

Re: Attention all N900 Vodafone users in the UK!
Well I've been on the phone to a manager at vodafone for 30 minutes and I finally convinced him that they've violated the contract. If you show them a time where you have gone over 500mb and not been charged, they will agree that the contract has changed. You can then cancel the contract if you want to.
|
Re: Attention all N900 Vodafone users in the UK!
if I cancel my contract do I have to return the phone ?? - I surely can't get to keep it !
|
Re: Attention all N900 Vodafone users in the UK!
If you cancel the contract, you have to return the phone. Also, because you are cancelling the contract, you can't keep the number either.
|
Re: Attention all N900 Vodafone users in the UK!
well you dont need vodafone to breach their conditions to do that, you can do that anytime, return the handset or pay the early termination fee
if they are in breach or increase their charges without your agreement you can cancel the contract and keep the phone |
Re: Attention all N900 Vodafone users in the UK!
So if they've violated the contract, which they have, I can cancel the contract and keep the phone?
|
Re: Attention all N900 Vodafone users in the UK!
it's open to debate whether they've breached the contracts... it seems possible that if they charge you for data and that increases your bill by more than 10% you can cancel and yes in that case you can keep your phone

Well I had them on the phone earlier ready to cancel my contract. I convinced the guy to do it. However, he told me that if I were to cancel the contract, I would lose my phone. Reading here, and reading through my contract, it now seems to be a lie. I will be having strong words with them tomorrow (or today even, it's almost 1 :p).

Re: Attention all N900 Vodafone users in the UK!
well now Pr1.2 is out i am goign to try and cancel Vodafone are really bad i wish i had stayed with O2 but at the time they didnt have the N900.
typically they got the phone a month or so after i had cancelled. a joke on their part as well mind you. This is just added ammo for my rant |
Re: Attention all N900 Vodafone users in the UK!
Well got the PR1.2 update and missed a called from the Directors office at Vodafone as the 3G signal I "forced" the phone to use dropped as I dared to move the bloody thing!
Anyways, they have my emails (so far unanswered) to the CEO and Directors office and I will get a call tomorrow. Hmmmmm....... |

Re: Attention all N900 Vodafone users in the UK!
Seeing as they were available on another forum I'll post them underneath.
My phone conversation wasn't brilliant. Essentially Lisa in the Directors office agrees that I disagree with them and their definition of unlimited and change in contract but they will not allow any penalty free cancellation. From 01/06 they will text you when you go over and on the 3rd month phone you to see if a different tarriff may help. You may be able to cancel at that point but will be down to Senior Management discretion. I've told her I'm not paying any more and that my contract has never stated charges. I've also explained I am not limiting or restricting my use because of this either and will await their call. See found it amusing that my usage has suddenly increased since this and I encourage others to use as much as they like as it's only now they are bothering to clamp down!! Grrr. Not happy. Roll on 21/01/11 when they won't be suprised I'm not staying! vittorio.colao@vodafone.com guy.laurence@vodafone.com and vodafonedirectorsoffice@gb.vodafone.co.uk Enjoy! |
Re: Attention all N900 Vodafone users in the UK!
So, could someone give me a definitive answer.
If we cancel our contract, can we still keep our phones? |
Re: Attention all N900 Vodafone users in the UK!
Quote:
But I remember Vodafone saying that they are selling you the service and the phone is included and as Vodafone don't manufacture the phones themselves they have no control over asking for them back. Don't take my word for it, that's just how I understand it is, which may be entirely wrong, considering the absolute utter amount of conflicting information being thrown about on the Vodafone eForums at the moment. Really starting to detest Vodafone now. |

Thanks for the info :) Where can I find the most "update-to-date" letter of complaint? |
Re: Attention all N900 Vodafone users in the UK!
people who have canceled, what have you said to the reps to get out of your contract?
|
Re: Attention all N900 Vodafone users in the UK!
so, we've passed the 1st of june.Did anyone at all get a letter or text or phonecall?
I haven't received anything, and I made sure I went over 500mb. Will and do the same again this month just in case. Then if they charge me I guess that is a valid cause for terminating the contract due to them making changes (which they also HAVEN'T notified me about). Could possibly even play dumb when/if they charge me in case they try and say that if I knew about charges via the web, then that counts as being notified. Anyone else? |
Re: Attention all N900 Vodafone users in the UK!
My plan of action is the same. I have not been notified so I will wait to be called. When they ask me to pay more - i will refuse - mentioning what you just did.
Given no choice I will ask for the following: - Increase my allowance to 1GB. or - Cancel my contract I wonder which one they will go for. If they try to charge a termination fee I will cancel my direct debit, and raise a complaint with the FCC. |
Re: Attention all N900 Vodafone users in the UK!
Still no notification of any extra charges for me. No letter, no text, nothing. used 700mb during May, intend to use at least the same again through June. Surely if they really intended introducing these charges they would have notified all thier customers?
|
Re: Attention all N900 Vodafone users in the UK!
My internet usage over the last 3 months has been:
March - 700.421MB April - 660.995MB May - 1.091GB I have not heard anything from Vodafone regarding this yet. I wonder how long it will take them to tell me to cut down. |
Re: Attention all N900 Vodafone users in the UK!
I got a text today saying Im over 500mb and to contact customer services. They can get stuffed! I'll wait until they charge me and them I'm cancelling
|
Re: Attention all N900 Vodafone users in the UK!
Thing is my account is one i got with the HTC Magic so maybe the limit is different for that phone as i have not received any texts or emails from them.
