Regarding my accepted submission phoneME for Maemo - the open source JavaME virtual machine originally developed by Sun (now Oracle) which I ported to various problems including Maemo and MeeGo - I have some concerns with me being able to comply with the Nokia Terms and Conditions for publishing the app in the Nokia Store.

There are a bunch of technical requirements in the Nokia's T&C that are difficult to comply with as phoneME is not an end-user application but rather an enabling technology to run other applications (i.e. midlets). For example, I cannot guarantee that all passwords will be safely stored or that phoneME will not adversely affect the operation of a Target Device if the midlet running on top of phoneME is not properly designed and developed with security in mind. The T&C also seem to be incompatible with phoneME's original license, i.e. GPLv2.

I have send a request for clarification for these and other issues to Nokia Support last week, but have not yet received a reply. As the original code is owned by Oracle, I also got in touch with two (technical) people within Oracle who were involved in the phoneME project and who are familiar with my ports.

Their feedback is that if I would go through Oracle legal to ask for permission to upload the port, that it would take a long time and in the end they will say no anyhow as the Nokia T&C is specifically not the GPLv2. They suggested asking Nokia for an exemption and provide a pointer to my website rather than publishing the actual build. They are OK with my putting all my builds and sources on my website, as I comply with the GPLv2 license.

I don't want anybody to end up in a bunch of legal discussions. My only motivation to apply for a N9 is to be able to reproduce issues reported by the community on a real device. So, I see three ways ahead now:
* Either Nokia is OK with the GPLv2 or with a pointer to my website (breaks the point of the Summer 2012 Device Program)
* Or I make my own simple front end application that downloads phoneME from my website (dirty hack)
* Or I retract my submission altogether.

Any feedback on how to proceed from here is much appreciated.

@qgil: I dropped you an email with my contact information (address etc). I was told that the user id is something like AID-xxxxxx and can be seen clicking on 'Developer account' on the right side when you login. There is lots of GPL software on Nokia Store. Your application won't get rejected from Store for being GPL.

I confirm redak is GPL-3 and no problem w/ that ...

dispite they dont provide the source if user ask for it ...

It is more than just the GPLv2 license. There are some technical issues as well that are a bit more problematic for phoneME due to the nature of the application.

Section 5.2: While phoneME may not cause any problems by itself, some midlets running on top of it may behave stupid, and I do not want to be held accountable for it.

Section 5.4: Making a separate downloader application for phoneME from my website would violate this term

Section 6: I am OK with that as long as Nokia sticks to the terms of the GPLv2 license (which I doubt they will comply with)

Section 7.1: phoneME is a fairly complex piece of software with a large portion of the code owned and released under GPLv2 by Sun/Oracle, not by me. This is why I asked the Oracle guys about their opinion

Section 8: Nokia can modify whatever they want, but will they release the sources of the changes?

Section 16: phoneME is released without the classpath exception, so if somebody decides to package phoneME with his/her closed source midlet, they have to open source their app too.

Section 17.5: IANAL, but these terms seem to be in violation with the GPLv2 license

Section 17.6.5: phoneME is an enabling technology to run other applications which can impair the operation of your device.

Section 4.9: So, you all promise to respond to customers within five business days? I am already getting a lot of mails why some midlets do not work (basically because I do not support all JSRs, or bugs in the midlets themselves). I for sure cannot guarantee I will always respond to issues within this time period.

I don't want to sound paranoid, but I presume these T&C are there for a reason. Just submit and see what happens is not something that I would feel comfortable with. Also, the fact that there are many GPL applications in the store is not a solid reason.
