Yeah...doesn't give me warm fuzzies either.
you'd think there was a deliberate desire to keep linux out of devices eh?

I agree. I like the concept but the implementation is a challenge.

    I did so again!
And did it again! No answer from those *** after 2 weeks and at least three times mailing!
    So what does that say?
They just do not reply to any mails?
They do not care about MeeGoo?
They do not care about friendly people trying to make them aware?

Linux foundation wont do anything unless a real compony make a decion to act. Its like UN Where the countrys makes the decsition, but some Times' so it under UN flag. Linux foundation is just a flag or banner.

Could the linux foundation eventually become android's foundation?

    Honestly....
One of a few things at play here....

A- They knew nothing about it until it was just brought to their attention and are now scrambling to figure out what to do. (extremely unlikely...and if it were...not a good sign..)

B- They have allowed or been reimbursed for the use of trademark. (possible but ...highly doubtful... you would think it would be posted somewhere.)

C- They are going to/ are doing something about it (legalities and all) but are not at liberty to speak just yet. ( Most probable)

D- (Worst possible scenario...and highly unlikely) They aren't interested/ don't care what happens with their "charges" (so to speak) they should be caring for. THIS option "D" sets a very unsettling and alarming precedent. I do not believe this possibility is the case.

If the Linux foundation sued and won, what do you think the punitive damages would be. Just stop the infringement and/or monetary reward?

Hard to say... taking "liberties" freely using the brand name.
I'm sure a lot of work was indeed done on these misrepresented products....
but coat-tail riding is mighty low nonetheless....
and it portrays the brand in a light which is vastly different than it's original legit. intent. ...
Not to mention...what happens if the products are inferior, problematic, etc?...
it will put a very bad black stain on the brand.
    All around not good.
Bad spot for those offending companies to have put themselves into....
if indeed they willy-nilly absconded the trademark figuring the foundation is toothless.
