    Wayfinder TOS re Position Data

    In activating Wayfinder on my N810, I saw this in the Terms of Service:
    5.2 The Customer Information and the Position Information may be used by Wayfinder for purposes of a) execution of obligations and rights pursuant to the Agreement, b) performance of obligations imposed by law or regulations, c) maintenance of Wayfinder’s Customer databases for marketing of Wayfinder products and services and d) development as well as troubleshooting of Wayfinder products and services. The expression "maintenance of databases" includes obtaining of supplemental information relating of the Customer from publicly available registers such as registers containing information on the creditworthiness of the Customer. Use of the Customer Information and the Position Information shall cease when it is no longer necessary for the purposes stated in these TOS.
    Is it just me or does this sound like Wayfinder get's cc'd on data regarding where I travel?

    I still haven't tapped "I accept" yet; I am waiting for an e-mail response from them. If anyone has insights on that item (not [conspiracy] theories! ) please chime in.

    it sures sounds that way to me........i already accepted the TOS but i wonder if it was that way in the original TOS or if this is a change.

    i dont mind anonymous info going to a server if it ultimately gives me a product that i can use better- but potentially (and i say potentially because i do not know-- no alumin foil hat here) they have my name/my credit card info/ my n810 MAC address- they can track me anywhere.... not good we need some clarification on this.

    Wayfinder is not being sent any information about the Internet Tablet's software applications. The program doesn't connect to the Internet unless a customer selects to update the traffic or speedcamera database, which is updated through GPRS or Wifi. You can also select not to do this. Wayfinder will not receive information on where a customer is navigating with the Wayfinder map application.

    Untrue; e.g. when you try to get an evaluation license the program connects to the Internet. And, there are more events which cause the program to connect to the Internet.

    i can see that wayfinder needs to know if who you are (MAC address) if you are evaluating the program.... but what other "events" are you speaking of??

    You're excluding context in that reply. It goes without saying that an internet connection is required for registration and similar activities, but that wasn't the subject of the query, was it?

    And please list the other events.

    It does look like there is some dissonance between the ToS and Wayfinder's response... bears further exploration IMO...

    So there is position information they obtain but apparently not identifiable to me -- though that would take very little to change should someone or something decide so. I guess the advantage the IT has in being able to wish for support for it to phone home when lost and send along it's position (see other threads) exposes the ease with which privacy can be given up.

    Frank -- still no aluminum foil hat.... yet. ;-)

    to me this updated response is ambiguous at best and misleading i am ordering a new roll of tin foil just in case
