What I have stated repeatedly is that the purpose and intentional USE of someones access point without their permission IS THE CRIME.
Why is it a crime? because the router is not yours and you know that when you connect to it. You willfully connected to a network that is not yours.
It doesn't matter what YOU think about that act, the fact is such an action is trespass or unauthorized access to a computer network.
To claim that somehow one does not know that using someone elses stuff without permission is a foreign concept is specious.
