Is it at all possible that WiMAX can be achieved via software and that the existing hardware is capable of Software Defined Radio given the right firmware ???

Now that's an interesting thought. It very well may turn out that all the hardware needed is already inside the current N800 and just needs to be revealed through firmware. It was a while before anyone knew about the FM radio inside, right?
