    As far as persistent goes. What do you actually propose.

    I am unable to find anyone to talk to at Nokia care who knows anything.

    As I mentioned I phoned them on Monday and they told me the phone was fixed and on the way to the care centre I handed it in at.

    The care centre tell me they have received it as BER.

    When I talk to anyone they get confused until; the phone goes dead.

    In my case I truly get the impression Nokia is avoiding talking to its customers it has just out sourced it to (my guess from the accents) India. The best I get is a supervisor who promises to email me and never dose.

    Im sure someone has suggested this before, but if not, you need to send a certified letter to NokiaUsa (I know it may be difficult to find their address) And in very short and to the point terms present your reason as far as why they should be replacing your phone, then list all your attempts to contact them, etc and put a CC: Field at the top so they can see everyone you sent a copy to. Then you want to let them know that if they do not respond in x amount of days, you will be marching down to the local court system to file a claim in small claims court which they are required BY LAW to respond to.

    In my case (Against a website hosting company) I found out they had a registered agent in my county. So in my letter to the company trying to get out of a horrible contract I told them that they could let me out of it with no penalty OR they can respond to the lawsuit I would be filing in my local county and I also mentioned the fact that they were registered in my county and the judge may not look too kindly on a company trying to take advantage of one of his citizens.

    It took about 20 minutes from the time I faxed them my letter to them agreeing to let me out of the contract, to them agreeing to do so

    Update: more and more people having USB Mini Port troubles are getting their devices back: unrepaired, despite Nokia's statement. What is going on? The statement was released on the 17th and must clearly have reached all Care Centres by now?

    I am in the UK.

    But the advice is still valid here.

    This is more or less what I am hoping to do. I only have one problem

    When I get to small claims court they have to proove it was my fault and not a flaw in their phone. UK law is pretty clear on that,

    But as I see it the case will go like this.

    Nokia
    Yes your honour. the pads have been removed from the board our engineers tell us this is impossible without abuse from the user.

    Errr sorry I know that is wrong but I have no engineers to back up my claim.

    You might consider getting the word out to more blogs. A grassroots protest. Many of us have blogs. Like Texrat would could post dispassionate facts but at the same time warn that anyone considering purchasing a N900 should be wary. If any of you have contacts then aim higher, Slashdot or The Register come to mind.

    my usb port just came off this morning!!! =( had the phone before thanksgiving and is in good condition..no drops.. minor scratches from case.

    Yes I think this is exactly the correct response.

    Many of us. Myself included have tried not to get negative outside of this forum. Due to our desire to prevent the whole Open source platform from being beaten down with Nokia bad press.

    It is time Nokia understood that this is a choice on our part not a requirement.

    I have posted before that we should also start posting reviews on sales sites. Polite but firm.

    But if we do this I think we should be united in how we handle it.

    Flydeeps slashdot post is perfect.

    If this technician finds that it is not userdamage and disagrees with the first diagnoses, than he can just put it writing to us ( or email ) and then we can still see wether we can take your device under warranty.
    I've sent mine off to Nokia directly last week and are hoping they will make a different decision. If not, we will have to go down a different road.
