If you replaced the battery and still have that many issues you definitely have faulty hardware. Probably best to get rid of it.

I made 1 with the original graphic and another with a graphic I used for a windows 8 tile. Let me know if I need to tweak them at all, I don't have an N9 yet to see them myself.
